After topless flap, Ocean City enacts public nudity ban
WASHINGTON — The Ocean City Council unanimously passed an emergency ordinance today banning public nudity. The quick action followed mounting concern over social media posts claiming the Maryland beach is going topless.

If women bare their breasts on the beach in Ocean City, Md., they will be fined.
Ocean City Council on Saturday afternoon held an emergency meeting to pass an ordinance that bans women from going topless. A woman who violates the new city code will be subject to a $1,000 fine.
Women are still allowed to breastfeed in public, Councilman Wayne Hartman said, but that doesn’t extend to full exposure.
The council decision followed days of local and national media reports and public scrutiny about a Beach Patrol memo that may have been misconstrued.
Beach Patrol Capt. Butch Arbin in the Tuesday memo told his lifeguards not to take action against topless women on the beach.
Some sunbathers thought that meant it was OK to get naked above the waistline, but local government officials said that message was misinterpreted.
It was intended to tell Beach Patrol to focus on saving lives and let local police handle any public nudity violations.
“We have never been a topless beach and we will not become a topless beach,” said Mayor Rick Meehan.
“Each year thousands of families visit our beach to relax in an atmosphere free of this type of activity,” he said. “We respect their rights.”
City Solicitor Guy Ayres addressed the issue of equal protection, saying the council decision doesn’t violate a protected civil liberty.
“There is no constitutional right for an individual to appear in public nude…,” he said.
People don’t have the right to impose their lifestyle on others who have an equal right to be left alone, Ayres said.
“Females baring their breasts in public, although not offensive to everyone, is still seen by society as unpalatable,” he said.
